The Japanese didn't fire the first shot at Pearl Harbor, the US did!. A Navy destroyer (USS Ward) was patrolling just out side the entrance of the harbor and noticed a submarine on the surface that was not American. A message was sent (Stop & Identify yourself), It was a Japanese 2 man sub, that doesn't have a radio. The destroyer received no replay, so they fired a 4" deck gun and sank the sub. A short time later the plane's started the attack.

Technically yes, but it was part of the total Japanese taskforce whos mission was to destroy Pearl Harbor.
