Is It Legal To Be Nude In My Backyard?

I actually wrote to the Sheriff, County District Attorney, and State Attorney General here in Clark County (Las Vegas) Nevada.  Both the Sheriff's and Attorney General Offices failed to answer, though they did respond.  I'm still awaiting an answer from the DA.Additionally, I asked about nude driving and the minimum coverage required in my front yardor on my street.  I don't know if or when I'll ever get a response but at least I haven't been told I've broken any laws nor have I been visited by law enforcement.  I'm sure looking forward to apositive response in all cases.  Then, it'll just be a matter of getting my wife to accept my nudity or near nudity, or to even join me.  Jim

According to nudistlaw.com the relevant Nevada statutes read:
201.210, Open or gross lewdness: 1. A person who commits any act of open or gross lewdness is guilty: (a) For the first offense, of a gross misdemeanor. . . . 
201.220, Indecent or obscene exposure: 1. A person who makes any open and indecent or obscene exposure of his person, or of the person of another, is guilty: (a) For the first offense, of a gross misdemeanor. . . .
Since simple public nudity is not mentioned your activities would not be covered by either of these sections, but there are numerous other charges which could be applied, such as disturbing the peace or disorderly conduct. It is not unusual for law enforcement or government officials to refuse to tell you if what you are considering violates the law. For some reason they refuse to do that, but once you do it they will take action. For better advice than mine you should consult an attorney. If you do so, please let us know what you learn.

I received the same advice from both the Sheriff's and AG's offices - seek advice from an attorney.  You're right, they won't tell you what the limits are but will simply wait for a complaint then act to either advise you or arrest you on some charge.  I'm still hopeful, though, the District Attorney's office will  actually answer my questions.   Jim

I've been wondering about this one myself for a while now. I'm sure that it would be illegal if I was in full view of the world but what if I'm hiking on my own property and somebody wanders into the woods and sees me ? I think that if I'm out of sight of any neighbors property and someone is trespassing on my own and they see me then I'm safe. But here in Ct. you just never know. Any ideas on this one ?

Our state law in Ia says they have to prove "intent to offend" so if you carry shorts and try to cover up that should take care of it however nothing will gaurantee you won't get arrested and charged. If you are in a backyard the best insurance is simply to get to know your neighbors.  I have asked 2 out of 3 if they minded if we were nude around the hot-tub, and they didn't have a problem with it.  the third neighbor is not worth asking. So we feel comfortable on the deck but not in backyard.

Before you waste the money on a mouth piece (lawyer) The term offensive and open lewdness is determined by the reporting person AND by general consensus. IF the general public finds the activity offensive, youll get charged.
It really depends on the state in which you are located.   In at least a couple of states, just being nude can warrant a complaint with or without affront.  Read the state law(s) and then find out if your locality, county, etc. has additional ordinances.

I actually plan on calling our police dept next week to ask this question and hope to get a serious answer.  We are going to have new neighbors moving in soon.  I plan on speaking with them as well.  Our previous neighbors moved and they were more than tolerant of our nudism.  Though they were not nudists or practiced nudity in their home, they felt it was okay that we did what we did in the privacy of our backyard and they stated that ... "if they didn't like or were offened by what they saw ... they could either not look or close their shutters."  Needless to say ... the shutters remained open and several times we saw each other and they waved and smiled.  We have a couple of neighbors across the street that have commented positively on our right to do what we want in our backyard ... referring to our nudity.  But even with that ... I'd still like to know the law. :)

That bill of rights sounds great, but I do not think every city is going to agree with all of it. America is just a bit too prudish to have an open veiw like that. If it does turn out that there is a law stating it is legal to have a penis in open public view, then I will be one of the first (in my area at least) to take a walk down the street nude, but until then I will respect anyone who does not want to see it and cover at their request. My feeling is, if anyone accidentally sees me and says anything, I hope they will be cool about it and be okay with me covering up while they're around and not bring the law into it. I have been enjoying being nude in my own back yard and I hope to spend much more time out there naked. I feel it is well isolated and someone would really have to try to look in and see me. I have not said anything to my neighbors yet, but I have thought about it. I do not want people who don't want to see a nude man to get a surprize. If I notice anyone able to see, I will likely have a towel on me before I find out if they are upset about it. If it turns out they were just caught by suprise but don't care, I will resume what I was up to. I am not here to push my freedom to be nude to the point of bothering anyone. I will certainly not be having sex in my yard, I just do not feel it is private enough for that. Last week, while just laying out watching the clouds, I heard a group of people come out in the yard on the other side of the wall on one side of my yard. The wall is over 7 feet high, but I still made it a point to be quiet to not draw attention, and I kept a towel close to pull over me, just in case.

Well said.  I could not have said it better myself.  I know when I reached the third post I was thinking the very same thing- the best way to keep them from complaining is by making sure they can't see it without some form of out-of-the-ordinary-effort.  Walking in their backyard and glancing over the fence is normal.  Erecting a ladder to look over the privacy fence is not.  Waving hello to you and yours while watering the flowers is normal.  Crawling through the bushes to get a peek is not.  I learned that myself years back at a place I was renting.  A couple caught a glance of me in my yard while they drove past.  The only way they could see for sure "anything", is by stopping in the middle of the road (no pull offs) and crawling through the bushes.  Anddddd, wah lah!  They video taped me naked as a jay bid!  And they turned that over to the county sheriff who, after viewing it with a sgt. I personally knew, wrote them both tickets.  Voyeurism/invasion of privacy, trespassing and impeding traffic on a private roadway.  Long story behind it really, but essentially they left me alone and went back home with their pride bruised.

There seems to be a discrepancy with regards to suburban living and the law.  In rural areas, you can expect a degree of privacy and are given that by the separation and distances between homes.  In suburbia ... we live on top of one another, not my idea of a perfect place to live but ... we compromised.  We have only one real neighbor, the people next door.  Yes we have neighbors across the street but only one neighbor where their property abuts ours.  We are in a single story home.  We lived in a two story prior to this one and it was time to stop going up and down the stairs.  The home next door is two story.  Our previous neighbor knew of our lifestyle, respected us and waved and smiled when he'd see me walking about or doing different things.   We now have new neighbors.  There is one window that isn't quite obstructed enough to give us complete privacy from this one neighbor.    I wonder;  why is it okay for them to look down upon our backyard and we have to abide by some archaic rules and laws but if I sit on my roof and look down upon their backyard while they are in the hot tub ... I could be considered, peeping.  Why isn't it the other way around when they peep into my backyard from their 2nd story window?  We've take measures to obstruct that window's view but it'll take another year before the tree's large enough to do that.   In the mean time, we are working on measures to increase the height of the fence between us to at least 6ft.

Please be advised that the police do not always know the laws.  If you have a Law School in your area, call the Law Library. They'd be happy to look up public indecency or indecent exposure.

We live in a residential area of Jersey City. There are 16 two story houses per acre. The houses are on full basements. As a result, even the first floor windows have a view over our 6 foot fence. Our lot is 25 feet by 100 feet. The yard is 25 feet by about 40 feet.

I asked a very experienced litigation attorney friend of mine who is licensed to practice in Florida and Nevada. In urban areas and some rural areas, if a neighbor or passerby can readily see the naked person from a window, a public road or property, while inside a car passing by, etc...... then the naked person is subject to indecent exposure statutes.  Of course this does not apply to designated nudist areas.

And no state or local municipality gives a flying f**k about the "Nudist Bill of Rights" in an area not designated as nudist.

I read over a few of the replies to this, and two things stood out to me:

One, never fool with the law if you want an answer about something that can be used against you.
 I.e., asking, "Can I grow pot if no one discovers I do it?" is waving the red flag to the bull. So asking a law enforcement person about going nude is also putting yourself on their radar. I'd not do it.

That said, where you live and the moral turpitude of the local culture can give you an answer. Here in California, at least where I live, most people don't care, as long as you're not pointing your privates in an exhibitionist style in their direction. I've been "caught" nude by hikers and the water meter man while gardening, and quickly covered up, saying that the view out here was especially good today, wasn't it? (But then I'm female, and to no surprise, there are double standards to nude women vs. men.)  Hmmmm, sounds like a topic for another forum.

I just think that poling one's head above the masses by asking the law enforcement folks what the law is, well, ain't so schmart. Asking an attorney is probably the best course. And the PR from AANR is nice, but hardly relevant for every neighborhood across the US and world.

We just went thru this with our neighbor who can see us from their high window. Cops came to visit us and after seeing all we have done to give both side privacy. They told the neighbor to buy blind, plant shrubs, build a fence or Move.  We have been enjoying our yard nude for years and now they freaked out? i guess seeing me swim with another nude male was the issue. Either way the cops explained it that they should put up the block as if they dont want to see something they pay to block the view. no different then if we had junk cars or pigs in the backyard. Seems our local county and we are zoned farm does not have a law that requires you wear clothes in your back yard. nough said for us.

Artemisia brings up a good point and most likely one that I WILL follow from now on.  Like a couple people here, I enquired as to the legality of being nude in my backyard but got no response.   I think, with all we've tried to do to give us the privacy we needed and want ... if the cops come to my door, I'll meet them dressed, be polite and then show them what I've done to give us the privacy we wanted.  Furthermore ... I will tell them I had no idea that it was illegal to be naked in ones own backyard and I will be more careful in the future.  I would, however, like to know who complained so I can apologize and then I will go and talk to those neighbors...if they give me a hint of who snitched! LOL
