Australia has had legal nude beaches since 1975, longer than most of the world, and today every state and territory except Queensland has at least one officially recognized clothing-optional beach. The catch is that legality is a line on the sand: the declared area is legal, the dunes and the next beach along are not, and the police enforce the difference when someone complains.
How the law works
There is no national law on nudity. Each state and territory has its own offenses for exposure, offensive behavior or bathing dress, and each has its own mechanism for carving out a legal exception. A 2019 Bond Law Review article by Theodore Bennett describes the pattern: formal "free beach" declarations contain public nudity in a defined place rather than endorse it, and the law in practice depends heavily on police discretion. The declared areas are stable, most have survived for forty years, but several have been disestablished over time and councils in New South Wales and Victoria have periodically debated revoking others. Nudity outside a declared area is an offense everywhere in Australia, and the dunes behind a legal beach are the most common place people get fined.
South Australia: Maslin Beach
Maslin Beach, on the Fleurieu coast about 40 kilometers south of Adelaide, is where it started. The southern section was declared Australia's first legal nude bathing beach in February 1975, after years of visitors bathing nude there at risk of indecent-exposure charges. It is a long sandy beach under ochre cliffs, with the clothing-optional section at the southern end and a car park above it; the walk down is steep. Maslin hosts the annual Pilwarren Maslin Beach Nude Games, a family sports day that has run for decades. The water is cold outside the summer months. See the Australia listings for the exact boundary and parking.
New South Wales: Lady Bay, Cobblers and Samurai
Lady Bay, also called Lady Jane, is a small harbor beach below the cliff path at Watsons Bay in Sydney's east. It had been used nude for decades before Premier Neville Wran's government declared it a nude bathing beach in 1976, a year after Maslin. Nudity is permitted on the sand and in the water only; the path above is clothed and well used by walkers, so this is not a beach for the shy. It is reached by steps from the South Head Heritage Trail and has no facilities.
Cobblers Beach sits on the north side of the harbor at Middle Head in Mosman, inside Sydney Harbour National Park, a short bush walk from the car park at Middle Head Road. It is a designated nude bathing area; clothing is required in the surrounding bushland and grass. It is calmer and more family-friendly than Lady Bay, a sheltered sandy cove with harbor views and no surf.
Samurai Beach, at Port Stephens about two and a half hours north of Sydney, is the state's best-known ocean nude beach. The NSW National Parks and Wildlife Service, which manages it inside Tomaree National Park, states that the beach and its campground are clothing-optional and that clothing is required in the dunes, the surrounding bushland and on neighboring One Mile Beach. It is a long, exposed surf beach with real rips and no lifeguards, so take the surf seriously. The New South Wales member directory is where Sydney and Hunter regulars post beach days.
Western Australia: Swanbourne
North Swanbourne, in Perth's western suburbs, is one of two officially recognized clothing-optional beaches in the Perth area. The sanctioned section starts roughly 300 meters north of the Swanbourne car park and is signposted; the boundary was vague for years until signs went up in 2008. It is a wide Indian Ocean beach backed by dunes and the army's Campbell Barracks, with a regular crowd and strong afternoon sea breezes. Perth's other recognized beach and the handful of tolerated beaches elsewhere in the state are in the directory.
Queensland: Alexandria Bay, and the problem
Alexandria Bay is a surf beach reached on foot through Noosa National Park, a bush walk of a few kilometers from either the Noosa Heads or the Sunshine Beach side. It has been used as a nude beach for at least thirty years, and it has never been legal, because Queensland has no mechanism for declaring one. The gap between custom and law closes whenever someone complains: in April 2023, following complaints to the parks service that included reports of lewd behavior, police attended on a single Sunday and issued 11 wilful-exposure infringement notices, to ten men and one woman, and charged one man with an indecent act. Police have said that fining people for nudity at "A-Bay" is not a priority but that they respond to complaints. The Queensland Naturist Association has lobbied for decades for a legal beach, the local MP ran a community survey after the 2023 fines, and so far the state has not moved. If you go, you are accepting a real if modest risk of a fine.
The other states and territories
| State or territory | Status | Best known legal beach |
|---|---|---|
| South Australia | Legal at declared beaches | Maslin Beach (1975) |
| New South Wales | Legal at declared beaches | Lady Bay, Cobblers, Samurai, Tyagarah near Byron Bay |
| Victoria | Legal at beaches declared under the 1983 nudity legislation; Campbells Cove lost its status in 2015 | Sunnyside North (Mount Eliza), Point Impossible and Southside (near Torquay) |
| Western Australia | Legal at council-recognized beaches | North Swanbourne |
| Northern Territory | Legal at the area set by the Nudity Regulations | Casuarina Free Beach, Darwin |
| Tasmania | Tolerated at a few beaches; check the listing | Check the listing |
| Queensland | No legal nude beach; wilful exposure applies | None (Alexandria Bay is tolerated, not legal) |
Victoria is the state to read carefully. Its three remaining legal beaches are defined areas under the 1983 nudity legislation, and the Surf Coast Shire has stated that the law does not extend into the dunes; Campbells Cove near Werribee had its clothing-optional status revoked from 1 September 2015. Tyagarah in NSW survived a 2018 council proposal to revoke it, with Byron Shire choosing instead to deal with bad behavior directly.
Australian beach etiquette
Everything in the nude beach etiquette guide applies, with three local additions. Stay inside the declared area, because the fines are real and the dunes are the usual trap. Sun protection is non-negotiable; Australian UV in January will burn unexposed skin in fifteen minutes. And respect the surf: Samurai, Alexandria Bay and the Victorian beaches are ocean beaches without patrols. To find the regulars, start with the NSW and Queensland member pages, the state groups and the events calendar, where the Maslin games and the summer beach meets are listed.
