SCOTUS lets stand state court convictions for nude female breast

The link below is to a news report on the US Supreme Court declining to hear the case of a state court conviction of three women who exposed their breasts on a public beach. The Supreme court of New Hampshire found that the state law does not discriminate against women based on sex and that exposing the female breast is not free speech. The US Court of Appeals came to the opposite decision in a recent Colorado case. The Supreme's can only take so many cases each year so it could be they passed on this New Hampshire case with the intent to hear the Colorado case in the future. In the mean time your constitutional right to be nude is not decided.

In NY, where it is legal at parks, beaches and most other public places, very few women do so.

If some do it is likely that more will follow. It takes a lot of courage to be the first or first few at something new, but with more that use the freedom there will be more that follow. Think about it this way. There was a time when there were no clothing optional beaches. Some tested the water so to speak and may even have had legal problems because of it. As more nude bathers took over a certain area, it just became common place that nude bathing would be allowed.

There also would be more women who would exercise their top free right if men did not behave so rudely.

Agree completely with your second point.
However, concerning the first, it has been legal for women to be topless in NY since 1992 and it is still extremely rare. How long does it take for others to follow?

That's a question that only time can answer. Since trends in the U.S. seem to start in California, maybe when that state legalizes top freedom the wave will move east. The Colorado case could also be a catalyst.

You can't blame women for feeling uncomfortable because of the way the world has overtly sexualized the breast,and the fact that it's illegal. If it were legal AND we continued to work to recognize it just a body part, then women slowly might start to become more comfortable with it.

It has to start somewhere.

Why does Europe have no problem? Yet America does. It's how you are brought up. Unfortunately too many ate scared of themselves and their inability to control thoughts and urges. Basically grow up.

It's true - Europe is much more advanced in terms of accepting nudity and doesn't over-sexualize when it's not sexual. I guess we should maybe count our blessings that we're not as repressed as say the Middle East, however I don't feel like we're making any progress.

I personally think we have a large segment of Americans that wish for the "days of old" and as such they've attempted to keep laws that hearken back to the 50's and 60's, when some progress in relaxing morality laws was first being attempted...
